A. The following Terms and Conditions contain assumptions of risk and/or liability by Customers and limit and exclude liabilities, obligations and legal responsibilities which Mobile Telephone Networks Proprietary Limited (“MTN”) will have towards Customers and other persons.

B. These Terms and Conditions also limit and exclude Customers rights and remedies against MTN and place various risks, liabilities, obligations and legal responsibilities on the Customer.

C. These Terms and Conditions may result in Customers being responsible for paying additional costs and amounts and MTN may also have claims and other rights against the Customer.

D. To the extent that the Terms and Conditions or any goods or services provided under the Terms and Conditions are governed by the Consumer Protection Act, 2008 (“the CPA”), no provision of these Terms and Conditions is intended to contravene the applicable provisions of the CPA. Therefore, all provisions of the Terms and Conditions must be treated as being qualified, to the extent necessary, to ensure that the applicable provisions of the CPA are complied with.

E. The Customer must read these Terms and Conditions. Purchasing services will constitute as an agreement to comply with these Terms and Conditions.

• 1. Introduction

  1.1 MTN Post-paid and Prepaid customers stand a chance to win voice and data prizes when they subscribe and play the Trivia questions game, Unlock Y’ello, by answering the trivia questions (the Competition).

• 2. Competition Period

  This Competition will run from the 1st of March 2024 until 28 February 2025, both days included (Competition Period).

  2.2 The Competition will run weekly (Friday to the next Thursday) and will run daily from 00:01 to 23:59 (Competition Period).

  2.3 MTN may, in its sole and absolute discretion, amend or withdraw the competition with notice to entrants. The entrant must visit www.mtn.co.za or www.unlockyellow.mobi regularly for notices, updates and/or changes to services.

• 3. Who is eligible?

  3.1 To be eligible to enter, the entrant must:

  3.1.1 be a natural person; and

  3.1.2 be 18 years or older.

  3.2. Exclusions:

  3.2.1 The Directors, Permanent or Temporary Employees of MTN South Africa and their immediate/direct family members/dependents as well as Agencies of MTN South Africa shall not be eligible to participate in this Competition.

  3.2.2 Immediate family shall mean the MTN South Africa Employee’s spouse, parents, grandparents, children, grandchildren, adopted children and step members.

• 4. How to Enter:

  4.1 In order to participate in this Competition, the MTN South Africa customer should:

  4.1.1 Select the activation option for the competition on the USSD: *120*070# USSD menu; and

  4.1.2 Complete the activation instructions on the www.unlockyellow.mobi app.

  4.2 All text messages sent to the number *120*070# are free of charge.

  4.3 Subscription to the VIP trivia game level the is charged at R3.00 per day.

  4.4 Subscription to one of the promoted content services costs R3.00 per day for each service the customer chooses to subscribe to.

  4.5 MTN or its authorized agents will contact the winners once the draw is made.

  4.6 The winner should be the owner of the Mobile Subscriber Integrated Services Digital Network-Number (MSISDN) (cellphone number) used to participate in the Competition.

  4.7 Any dispute of ownership of the MSISDN will result in that MSISDN being disqualified from this Competition.

  4.8 To unsubscribe the customer must dial *120*070# and select the My Profile option.

• 5. How the Competition works?

  5.1 The Competition will run weekly (Friday to Thursday), daily from 00:01 to 23:59 and monthly.

  5.2 Customers will be awarded points for taking any one of the following actions while participating in the Competition. Each point is equal to one entry into the applicable draw.

  5.3 Customers who answer all questions sent to them correctly earn double the number of points for each of those questions. For example, if the customer earned 100 points by answering all of the day’s questions correctly, they will be awarded an additional 100 points for that day. The additional points awarded are applicable to the same draws as the points awarded for the original action(s).

  5.4 The draw for daily airtime winners will occur daily for the duration of the Competition. Airtime and data winners will be notified by SMS only.

  5.5 Data, Voice and airtime winners will not be subject to the content of clause 7.7

  The points will be allocated as follows:

• 6. The Prize

  6.1 All participants (including free, VIP level and content subscribers) stand a chance to win their share of 324 000 daily airtime and data prizes to the value of R 360 000.00. Winners will be selected randomly from the pool of qualifying entries.

  6.2 Draws for the daily prizes (airtime and data) will be conducted daily throughout the campaign for the previous day.

  6.3 Participants must submit a minimum of one valid answer to a trivia question, to be entered into the daily airtime draw.

  6.4 VIP participants must have had an active subscription during the time of the draw in order to qualify for entry into the draw.

  6.5 Content service subscribers must have at least one active subscription during the time of each draw in order to qualify for entry into the draw.

  6.6 Customers will have the opportunity to re-claim their previously earned points in the event that they accumulate points, opt-out of participation and subsequently opt back into participation.

• 7. General

  7.1 Airtime prizes will be credited to the account associated with the MSISDN selected as the winner for that airtime draw.

  7.2 Prizes not collected before the 31 March 2023 shall lapse and become void. MTN will make three attempts to contact the selected MSISDN (winner) to verify the owner’s personal details (proof of identification and address) and inform the winner of their prize. On the third failed attempt, an SMS will be sent to the winner’s MSISDN informing them to contact the MTN Contact Centre on 010 300 0880 before the end of the day, 12:00 midnight, of that specific day.

  7.3 Should the participant fail to make such contact the prize shall be given to the next drawn customer (alternate) and the process shall be repeated where necessary.

  7.4 MTN’s decision is final and no correspondence in this regard will be entertained.

  7.5 The draws will be done under the supervision of MTN ’s internal auditor and the entries drawn will be determined as the winners. The decision of the auditors shall be final and binding, and MTN will not entertain any further correspondence in this regard.

  7.6 Should the winner be a minor under the custody and control of his or her parent(s) or guardian, the minor shall provide full particulars and proof of identification of said parent(s) or guardian to whom the prize will be delivered. Such particulars and proof shall state, inter alia, the nature of the relationship between the winner and the parent(s) or guardian concerned. Such prize shall be registered in the name of the parent or legal guardian.

  7.7 Winners may be required to produce valid Identification.

  7.8 Once the winners have taken possession of their prizes, all risk and responsibility associated with the prizes passes to the winner and MTN will in no way take responsibility or assume any liability for, or in connection with, the prizes or the use thereof.

  7.9 MTN reserves the right to review and change this competition’s rules and format or cancel it altogether.

  7.10 MTN reserves the right to disqualify any customer from participation in this competition in light of any malpractice or manipulation of results that MTN believes has taken place.

  7.11 As proof of ownership, the winner must produce the handset and SIM card used to participate in the competition, along with the winner’s legal identification document.

  7.12 Winners may be required to sign acknowledgement of receipt of the prize.

  7.13 MTN shall be indemnified against any technical errors beyond its reasonable control.

  7.14 All MTN’s standard Terms and Conditions apply. Subscription to and use of the content services are subject to the Terms and Conditions applicable to that service.
